These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Deacon Products Ltd., the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.
In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Deacon Products Ltd. and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Deacon Products Ltd. and accessing the Website in connection with the provision of such services.
Products
1. Sizes stated are approximate only, these together with the product designs may be changed without prior notification.
2. Where you see M.B.L. (Minimum Breaking Load) this figure is expressed in Kilonewtons (KN) and is taken from the manufacturer’s guideline figure. These are all applied to commercial items and therefore CANNOT be supplied tested.
3. Only products that are clearly marked with a Safe Working Load (S.W.L.) or Working Load Limit (W.L.L.) will be provided with a test certificate.
4. Misuse of any lifting gear or equipment, including exceeding the specified S.W.L. or W.L.L., can result in equipment failure, property damage, serious injury, or death. It is imperative to follow all safety guidelines and instructions provided. Deacon Products Ltd is not liable for any damages or injuries resulting from the misuse of our products.
Payment and pricing
5. Payment terms are as agreed upon between Deacon Products and the Buyer. Unless otherwise specified, payment is due within 30 days from the date of the invoice.
6. Goods may be invoiced at time of collection or dispatch for delivery, or at any time after such events.
7. No payment shall be deemed to have been received until Deacon Products Ltd, or its bank has received cleared funds.
8. All prices are quoted in GBP (British Pounds) and exclude Value Added Tax (VAT) unless otherwise stated.
9. The prices quoted are based on the current costs of production, materials, and exchange rates at the time of quotation. Deacon Products Ltd reserves the right to adjust prices due to changes in these factors.
Delivery, collection and returns
10. Delivery times are estimates and are not guaranteed. Deacon Products Ltd. will make every effort to meet agreed-upon delivery schedules.
11. The risk of loss or damage to the goods passes to the Buyer upon delivery.
12. The Buyer is responsible for inspecting the goods upon receipt and must notify Deacon Products Ltd. of any discrepancies or damages within 7 business days.
13. This service is subject to stock availability and capacity, ensuring that we can meet your needs efficiently. Please note that orders must be placed before the cut-off time 3pm to qualify for same-day collection. You will receive a confirmation email once your order is ready for pickup.
14. Returns and exchanges will be accepted within 7 days of delivery, subject to approval by Deacon Products Ltd. Goods must be in their original condition and packaging.
15. We cannot accept returns of bespoke products and any that are cut to length. All returns must be accompanied by a goods return number which will be issued by our office.
Intellectual property and acceptable use
16. All Content included on the Website, unless uploaded by Users, is the property of Deacon Products Ltd., our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission
17. You may, for your own personal, non-commercial use only, do the following:
a) retrieve, display and view the Content on a computer screen
b) print one copy of the Content

22. Whilst Deacon Products Ltd. uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guaranty in that regard and all Users take responsibility for their own security, that of their personal details and their computers.
23. Deacon Products Ltd. accepts no liability for any disruption or non-availability of the Website.

28. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

34. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
